1. Algemeen
Welkom op bydanie.nl. Bydanie is ervan overtuigd dat de bescherming van de persoonlijke levenssfeer van bezoekers en klanten van haar websites van groot belang is voor haar activiteiten. In deze privacy verklaring informeert Bydanie bezoekers van de website over de wijze waarop Bydanie persoonsgegevens verwerkt en hoe bezoekers invloed kunnen uitoefenen op deze verwerking. Deze Privacy Verklaring heeft alleen betrekking op het gebruik van persoonsgegeven op de website www.bydanie.nl, hierna te noemen “de Website”. De informatie die Bydanie over bezoekers verwerkt (hierna aangeduid als: “persoonsgegevens”) wordt dan ook met de grootst mogelijke zorgvuldigheid behandeld en beveiligd. Bydanie als houdt zich daarbij aan alle geldende Europese en Nederlandse wet- en regelgeving, waaronder de Wet Bescherming Persoonsgegevens. 2. Definities

3. Het verstrekken van persoonsgegevens is niet verplicht
3.1 Uitgangspunt is dat het verstrekken van persoonsgegevens aan Bydanie niet verplicht is. Bezoekers hebben te allen tijde zelf de keuze of eigen persoonsgegevens worden verwerkt. Echter, om gebruik te kunnen maken van de website is het invoeren van persoonsgegevens noodzakelijk. Als de invoer van gegevens wordt gevraagd, wordt vervolgens altijd aangegeven welke gegevens noodzakelijk zijn om van de dienst gebruik te kunnen maken en dus moeten worden ingevuld, en welke gegevens optioneel kunnen worden verstrekt.
 

4. Welke persoonsgegevens worden verwerkt?
4.1 Bydanie verwerkt persoonsgegevens bij het aanbieden van diensten. Het gaat hierbij om gegevens als naam, contactgegevens, geboortedatum, geslacht, e-mailadres en gegevens over interesses van de Bezoeker. De verantwoordelijke verzamelt automatisch gegeneerde informatie over het surfgedrag van gebruiker. Deze informatie bestaat onder meer uit het IP-adres en de sessie-cookies.
 

5. Cookies
5.1 Bydanie maakt tijdens een lopende sessie gebruik van sessie-cookies die op de browser van de computer van gebruiker worden opgeslagen. Dit zijn kleine stukjes informatie die onze server naar jouw browser stuurt, zodat het gebruik van de Website gedurende een sessie wordt vergemakkelijkt. Indien een gebruiker bijvoorbeeld tijdens een sessie teruggaat naar een vorige pagina, dan zal de informatie van die vorige pagina nog steeds bekend zijn.
5.2 Bydanie maakt gebruik van affiliate cookies, deze worden automatisch verwijderd op het moment dat je de browser afsluit. Ook maakt Bydanie gebruik van een zogenaamde unique-id cookie, om een internetgebruiker te herkennen als unieke Bezoeker. Deze cookie heeft een levensduur van één jaar dat betekent dat deze automatisch verdwijnt zodra je langer dan één jaar niet meer de Website bezoekt. Tot slot maakt Bydanie gebruik van tijdelijke cookies. Deze tijdelijke cookies registreren je surfgedrag op de Website gedurende maximaal tien dagen. Wanneer je voor de elfde dag contact maakt met Website, verdwijnen de gegevens van dag één uit de cookie. De informatie die via deze cookies wordt verkregen, wordt 60 dagen na je laatste bezoek automatisch verwijderd.
5.3 Bydanie slaat cookies op voor de technische opslag of toegang tot gegevens met het uitsluitende doel om de communicatie over een elektronisch communicatienetwerk uit te voeren. De communicatie op de website kan in sommige gevallen uitsluitend plaatsvinden door een cookie te plaatsen. Daarnaast maakt Bydanie gebruik van cookies welke strikt noodzakelijk zijn voor de opslag of toegang tot de Website.
5.4 Indien Bydanie gebruik maakt van cookies voor andere doeleinden dan in de 4.3 opgesomde doeleinden, heeft Website expliciete toestemming van de Bezoeker nodig op grond van art. 11.7a Telecommunicatiewet. De Bezoeker van de website zal vooraf worden geïnformeerd waarom Bydanie deze cookies nodig heeft, wat het voordeel is voor de Bezoeker van de website, dat de toestemming altijd ingetrokken kan worden en ten slotte wordt de gebruiker gewezen op de gevolgen van het gebruik van deze cookies.
5.5 Indien de Bezoeker zijn toestemming niet wenst te verlenen aan het verzoek van Bydanie om de cookies te mogen gebruiken dient de Bezoeker het toestemmingsverzoek te weigeren. In dat geval kan het voorkomen dat de Bezoeker niet van alle mogelijkheden van de Website gebruik kan maken. Iedere keer dat de Bezoeker een deel van de website wenst te bezoeken kan het zijn dat Bydanie een toestemmingsverzoek doet voor het gebruik van cookies.
5.6 Indien de Bezoeker zijn toestemming niet wenst te verlenen aan het gebruik van cookies kan de browser zo worden ingesteld tijdens het bezoek aan de website geen cookies worden gebruikt. In dat geval kan het echter gebeuren dat de website niet toegankelijk is. De browser kan door de Bezoeker zo worden ingesteld dat de Bezoeker wordt geïnformeerd als er een cookie wordt geplaatst. Via “HELP” in de toolbar van de meeste browsers vind de Bezoeker meer informatie over de instellingen van de computer.
5.7. Website kan de persoonsgegevens van Bezoeker die door haar worden verwerkt, uitwisselen met haar groepsmaatschappijen en deze persoonsgegevens combineren met gegevens die zijn verzameld in het kader van een aankoop of gebruik van producten of diensten van Bydanie of haar groepsmaatschappijen, waaronder ook via cookies verzamelde surfgegevens. Dit noemen we derde partij cookies. Onder andere Google en haar groepsmaatschappij DoubleClick presenteren in opdracht van Bydanie advertenties op Website. Zij plaatsen daarvoor tevens cookies op je computer. Op het gebruik van cookies door derde is het privacy- en cookiebeleid van het desbetreffende bedrijf van toepassing. Adverteerders of andere bedrijven hebben geen toegang tot de door Bydanie geplaatste cookies.
5.8 Als Bezoeker kan het gebruik van cookies door Google worden afgemeld op http://www.google.nl/privacy_ads.html. En voor haar groepsmaatschappijen kan er worden afgemeld op http://www.youronlinechoices.eu/nl voor het plaatsen van cookies door andere advertentienetwerken die in opdracht van Bydanie op Website advertenties presenteren.
 

6. Voor welke doeleinden worden persoonsgegevens verwerkt?
6.1 Bydanie gebruikt de gegevens van Bezoeker in verband met de volgende doeleinden:
– het leveren van de producten en diensten van Website;
- om de Bezoeker in de gelegenheid te stellen informatie te plaatsen en uit te wisselen op een van de websites, of indien de website die mogelijkheid biedt contact op te nemen met andere Bezoekers;
- om gericht aanbiedingen te doen, zo kan bijvoorbeeld een advertentie worden getoond van een product waarvan Bydanie op basis van door haar verwerkte gegevens vermoedt dat de Bezoeker interesse heeft. In het kader van de optimalisatie van het doen van de aanbiedingen kan Bydanie een profiel van de Bezoeker opstellen;
- om de Bezoeker een nieuwsbrief, aanbieding, gebruikersinformatie, service bericht of andere elektronische boodschap toe te sturen;
- om haar websites en bijbehorende technologieën te analyseren, te onderhouden, te beveiligen en te optimaliseren en;
– het voldoen aan de op Bydanie rusten wet- en regelgeving verplichtingen;
6.2 Bydanie kan nieuwsbrieven naar de Bezoeker verzenden als Bezoeker hiervoor uitdrukkelijk toestemming heeft gegeven. Deze toestemming kun de Bezoeker altijd weer intrekken of aanpassen via http://bydanie.us1.listmanage1.com/unsubscribe?u=fc8c6923667c45904dee3b25a&id=7e30759a7f
6.3 Bydanie bewaart persoonsgegevens van de Bezoeker in beginsel zolang als dat nodig is voor bovengenoemde doeleinden, of om te voldoen aan wettelijke (bewaar)verplichtingen.
 

7. Doorgifte van persoonsgegevens aan derden
7.1 Bydanie geeft de persoonsgegevens van Bezoeker slechts aan derden door als Bezoeker hiervoor toestemming heeft gegeven.
7.2 Door met deze Privacy Verklaring akkoord te gaan geeft de Bezoeker Bydanie toestemming om gegevens aan zorgvuldig geselecteerde derde partijen te verstrekken, welke direct betrokken zijn bij de Website en alleen voor zover dit noodzakelijk is in verband met de hierboven onder (3.1) genoemde doeleinden.
7.3 Alleen als de Bezoeker daarvoor ondubbelzinnige toestemming heeft gegeven, kan Bydanie elektronische gegevens gebruiken voor het toesturen van informatie en aanbiedingen van zorgvuldig geselecteerde derde over hun producten en diensten. Dergelijke informatie en aanbiedingen zal altijd worden verstuurd vanuit Bydanie. De informatie en aanbiedingen van derden beoordeelt Bydanie ook altijd voordat deze door haar wordt verstuurd. We selecteren deze derden op basis van de informatie die we hebben verzameld over jouw productafname, internetgedrag en/of abonnementen. Deze derden zullen de gegevens van Bezoeker vervolgens gebruiken om aanbiedingen te doen waarvan wordt verwachten dat die aanbiedingen ook aansluiten bij de interesses van Bezoeker. Bezoeker kan een verleende toestemming voor het gebruik van je elektronische gegevens door derden weer intrekken door een email te sturen naar info@bydanie.nl
7.4 Bydanie kan in bijzondere gevallen, ongeacht de toestemming van Bezoeker daarvoor persoonsgegevens aan derden ter beschikking stellen. Speciale gevallen zijn bijvoorbeeld rechtmatige verzoeken daartoe van autoriteiten, dagvaardingen of gerechtelijke bevelen, handelingen om schade of fraude op te sporen of te voorkomen, of handelingen om de veiligheid van het netwerk en de diensten van Bydanie te garanderen. Tevens zal Bydanie persoonsgegevens verstrekken aan zogenaamde bewerkers die in opdracht van Bydanie producten of diensten leveren, waarbij (tenzij anders aangegeven) persoonsgegevens van Bezoeker enkel zullen worden gebruikt voor het uitvoeren van die leveringsverplichting.
7.5 Bydanie kan bepaalde geanonimiseerde gegevens delen met derden, zoals het aantal Bezoekers dat met een bepaalde zoekterm heeft gezocht, of hoeveel Bezoekers op een bepaalde advertentie hebben geklikt. Aan de hand van deze gegevens kun je niet worden geïdentificeerd.
 

8. Beveiliging van persoonsgegevens
8.1 Bydanie maakt gebruik van een passend technisch en organisatorisch beveiligingsniveau die gelet op de stand van de techniek voldoende moeten worden geacht om de ongeoorloofde toegang tot, aanpassing, openbaarmaking of verlies van persoonsgegevens te voorkomen.
 

9. Inzage, wijziging en verwijdering van jouw persoonsgegevens
9.1 Op ieder moment kan om inzage in de (persoons)gegevens worden verzocht die Bydanie heeft verzameld. Ook kan de Bezoeker een verzoek doen om zijn gegevens te laten wijzigen of verwijderen. Hiervoor kan de Bezoeker een e-mail sturen naar de Website, via het contactformulier op de website.
9.2 Indien er niet langer prijs wordt gesteld op het verstrekken van jouw persoonsgegevens aan derden of het gebruik van jouw gegevens voor het doen van gerichte aanbiedingen of op het per e-mail ontvangen van informatie en aanbiedingen, kan intrekking van toestemming door middel van een email plaatsvinden. Indien Bydanie niet of niet volledig kan vaststellen op welke persoonsgegevens het verzoek tot inzage, wijziging of verwijdering betrekking heeft, kan Bydanie de Bezoeker vragen om zijn verzoek (nader) te specificeren. Bydanie schort de uitvoering van het verzoek van Bezoeker op totdat Bydanie de (nadere) specificatie heeft verstrekt. Bydanie stuurt de Bezoeker na uitvoering van het verzoek altijd een bevestigingsbericht.
9.3 Zo spoedig mogelijk na ontvangst van het verzoek van Bezoeker zal Bydanie het gebruik van jouw gegevens voor de doeleinden waartegen jouw verzet zich richt beëindigen. En in geval van een rechtmatig verzoek om verwijdering of wijziging van gegevens, de betreffende persoonsgegevens verwijderen of wijzigen, tenzij en voorzover de wet Bydanie verplicht om de betreffende persoonsgegevens te bewaren of er (andere) dringende redenen zijn die zich tegen verwijdering verzetten.
9.4 Ook geeft de Website de Bezoeker het recht om zijn eigen persoonsgegevens zelfstandig in te zien of te wijzigen, en kun de gebruiker de persoonsgegevens die hij zelf heet ingevoerd, verwijderen via de daartoe gegeven mogelijkheden.
 

10. Minderjarigen
10.1 In sommige gevallen vraagt de verantwoordelijke expliciet om toestemming om bepaalde persoonsgegevens te kunnen gebruiken. Als de Bezoeker jonger is dan 16 jaar, heeft de Bezoeker in die gevallen de toestemming van zijn of haar ouder of voogd nodig om de persoonsgegevens te verstrekken aan de verantwoordelijke. De ouder of voogd kan in dat geval ook altijd de aan verantwoordelijke verstrekte gegevens aanpassen of verwijderen.
 
11. Wijzigen van het privacy- en cookiebeleid
11.1 Bydanie behoudt zich het recht voor haar privacy- en cookiebeleid aan te passen. Bydanie adviseert de Bezoeker dan ook regelmatig op deze pagina te kijken of er veranderingen zijn doorgevoerd. Indien Bydanie wezenlijke wijzigingen aanbrengt zal Bydanie er zorg voor dragen dat er op een meer dan opvallende wijze kennisgeving plaats vindt, bijvoorbeeld via email.

3. Providing personal data is not required
3.1 Providing personal information is not mandatory. Visitors always have the choice not to let their personal data be processed by the Controller. However in order to make use of all the functionalities of the website the process of personal data could be necessary. Some services can only be provided when the Visitor has accepted the process of his personal data.
 

4. Which information is collected?
4.1 Bydanie processes personal data by providing her services. Personal data such as names, contact information, birth date, gender, email address and information about interest of the Visitors. Besides this information the Controller will also automatically collect information about surfing habits of user. This information consists of the IP address and affiliate cookies.
 

5. Cookies
5.1 Bydanie makes use of session cookies that are stored on the browser of the Visitor. These cookies are small pieces of information that our server sends to the browser of the Visitor(s) computer, so the use of the Website is facilitated during a session. For example, if a Visitor wants to go back to a previous page during his session, then the information of that previous page is still available.
5.2 Bydanie makes use of affiliate cookies, these cookies will automatically be deleted when the browser is closed. Bydanie also makes use of a so-called unique ID cookies. So Visitor(s) can be identified as a unique Visitor(s). This cookie has a lifespan of a year what means that it automatically will be deleted once a Visitor has not visited the Website for more than a year . Finally, Bydanie use temporary cookies. 6. For what purposes are personal data processed?
6.1 Bydanie processes the data of Visitor(s) for the following purposes:
- For the delivery of products and services of the Website;
- To give Visitor(s) the opportunity to post information and exchange information with other Visitor(s) of the Website, or to get in contact with other Visitor(s);
- For targeted offers. Bydanie can place ads of products or services that are based on Visitor(s) interests. In the context of optimizing the deals Bydanie can draw a profile of Visitors;
- To send Visitors newsletters, offers, user information, services, messages or other electronic messages;
- To analyze, maintain, protect and optimize its websites and related technologies;
- Complying with all the regulatory obligations;

7.1 Bydanie only gives personal information to third parties as Visitor’s have given their explicit consent.
7.2 By agreeing to this Privacy Statement, the Visitor has given Bydanie permission to carefully select and provide third parties with the personal data of Visitors. The third parties are directly involved in the Website and have access to the data only to the extent necessary in connection with the under (3.1) mentioned purposes.
7.3 Only with the unambiguous consent of the Visitor, Bydanie can use personal data to send electronic information and offers from carefully selected third about their products and services. Bydanie will always send information and offers. Bydanie always evaluates the information and promotions from third parties before it is sent to Visitor(s). Bydanie selects these third parties based on the information we have collected about your product purchases, internet behavior and subscriptions. These third parties will then use Visitor(s) personal data to make offers that are aligned with the interests of the Visitor. Bydanie will also provide personal information to editors who on behalf of Bydanie provide products or services.
7.5 Bydanie can share certain anonymous data with third parties, such as the number of Visitor(s), or how many Visitor(s) have clicked on a particular advertisement. On the basis of these data no identification of a Visitor(s) can be made.
 

8. Security of personal data
8.1 Bydanie uses the appropriate technical and organizational security measures to protect the personal data of the Visitors. Given the fact that these measures are deemed to be the state of theart, protection should be considered sufficient to prevent unauthorized access, alteration, disclosure or loss of personal data.
 

9. Inspection, modification and deletion of your personal data
9.1 At any time a Visitor(s) may request to get access to all the (personal) data that Bydanie has collected and processed. Visitor(s) can also submit a request for its data changed or deleted. The Visitor can send an e-mail to the Website, using the contact form on the website.
9.2 If Visitors do not want to let their personal data be processed by third parties or that their personal date is being used for targeted offers. Visitor(s) can withdraw their consent by sending an e-mail. If Bydanie can not or not fully identify the Visitor(s) questions in relation with his request for inspection, modification or removal of personal data, Bydanie will ask to specify the request. Bydanie will suspend the execution of the request of the Visitor(s) until Bydanie has been provided with further specification. After the execution of the request Bydanie will send the Visitor(s) a confirmation message.
9.3 After Bydanie received the request to stop processing personal data of the Visitor(s), Bydanie will terminate processing Visitor(s) personal data as soon as possible. And in case of a legitimate request for removal, alteration, deleting or modifying the personal data this will also take place as soon a possible, except to the extent that Bydanie could de obligated by law to keep personal information. Bydanie could have (other) compelling reasons to ressist against the elimination of the personal data.
9.4 The Website also gives the Visitor the right to see or change his own personal data, and the Website allows the Visitor to remove personal data from the appropriate data capabilities.
 

10. Minors
10.1 In some cases, the controller will aks for the explicit permission to use personal data. If the Visitor is younger than 16 years, the Visitor in such cases has to have consent of his or her parent or guardian for the processing of personal data by the controller. The parent or guardian may in that case have the right to modify or delete the personal data of the minor.
 

11. Changing the privacy and cookie policy
11.1 Bydanie reserves the right to adapt her privacy and cookie policy. Bydanie advises the visitor to regularly check the Website to see if changes are made. If Bydanie has made substantial changes in her privacy and cookie policy it will ensure that there is a more prominent way to notify the Visitors, for example through email.
